George Gascón's Policies May Have Directly Led to the Murder of Two El Monte Police Officers (VIDEO)

Gascón's recall can't come soon enough.

The man who shot and killed two El Monte police officers Tuesday could have faced significantly more time in prison when he was last charged with a crime. But one of Dist. Atty. George Gascón’s most heavily criticized policies probably resulted in a lower sentence, according to documents reviewed by The Times.

Justin Flores, 35, who also died in Tuesday’s confrontation, was charged with being a felon in possession of a firearm and methamphetamine when he was arrested by Los Angeles County sheriff’s deputies in 2020.

Flores had been convicted of burglary in 2011. Burglaries are strike offenses, which make suspects charged with later crimes eligible for harsher sentences. Flores’ earlier conviction means he had one strike against him when he was charged in 2020.

But the prosecutor assigned to the case, Deputy Dist. Atty. Larry Holcomb, said he had to revoke the strike allegation after Gascón took office, according to a disposition report reviewed by The Times. That’s because the new D.A. had issued a “special directive” that barred prosecutors from filing strike allegations on his first day in office.

Gascón’s policy regarding strikes was later deemed illegal by a Los Angeles County Superior Court Judge, after the union representing rank-and-file prosecutors sued, seeking an injunction. In February 2021, Judge James Chalfant ruled Gascón’s policy violated California’s “three strikes” law, which requires prosecutors to file strike allegations whenever a defendant has a previous serious or violent felony conviction.

An appellate judge upheld Chalfant’s ruling earlier this year.

Flores pleaded no contest to being a felon in possession of a firearm in 2021, and prosecutors agreed to drop all other charges, records show.

Though the gun conviction alone could have sent him to prison for up to three years, by pleading no contest, Flores was instead sentenced to two years’ probation and 20 days in jail.

There is no guarantee Flores would have still been in jail Tuesday, when he shot and killed El Monte Police Cpl. Michael Paredes and Officer Joseph Santana as they responded to a reported stabbing at the Siesta Inn.

But the removal of the strike allegation certainly cost prosecutors leverage when negotiating a plea, according to criminal justice experts.

Laurie Levenson, a professor of criminal law at Loyola Law School, said the blanket policy to disregard strike allegations was always going to run into trouble.

“If you are going to implement a blanket policy, you are always in danger of having a Willie Horton moment,” she said, “where that decision applied to one case results in a horrible outcome.”

Horton was convicted of first-degree murder in Massachusetts and sentenced to life in prison without parole. He escaped while on a weekend furlough program in 1986, then brutally raped a woman and assaulted her boyfriend.

The Horton case was used in an infamous attack ad against then-Massachusetts Gov. Michael Dukakis, who was running for president in 1988 against George H.W. Bush.

Gascón has moved away from such blanket policies in recent months. Prosecutors can now request approval from a committee to either try juveniles as adults or pursue special circumstances allegations in murder cases, tactics Gascón had initially outlawed when he took office.

Biden's (In)competence

When Biden was running for president, his message was pretty straightforward: I'm the guy who will bring normal back to Washington. Where President Trump was unorthodox and chaotic, Biden would be conventional and organized. Trump ran the White House like a reality show, Biden stocked his cabinet and high-level staff with Washington insiders with establishment credentials. He was going to usher in an era of boring, but predictable.

But, less than a year into his tenure, voters don't see the 'return to normal' they had been promised. Far from turning the corner on COVID, the country remains anxious and divided over everything from booster shots to vaccine mandates. A botched Afghanistan pull-out was quickly followed by more chaos on the southern border. Earlier success at bipartisan legislating has dissolved into intra-party fighting over the contours of the president's signature legislation.

"I'm kind of a little weary," said one woman in a recent focus of voters who had supported Trump in 2016 and Biden in 2020. "I think it [Biden's term] started off strong, but some scary things are happening now."

All of this has taken a toll on Biden's standing with the public. Not only are his national job approval ratings underwater (the fivethirtyeight.com average currently has him at 46 percent favorable to 49 percent unfavorable), but he's slipped under 50 percent in a recent Washington Post poll in Virginia — a state he easily carried in 2020. Private polling is picking up double-digit drops in Biden performance in competitive House seats.

There's nothing that remarkable — or unique — about a first-term president hitting a soft patch early in his tenure. New presidents often confront a crisis they didn't expect. For Bill Clinton, it was the April 1993 stand-off in Waco, Texas, between federal law enforcement officers and cult leader David Koresh that resulted in the deaths of 75 people. Other times, presidents create their own crises; Trump was probably the best at that (see: Comey, Charlottesville, late-night tweeting, etc.) Obama ran as a transformational candidate who would unify the country. However, his legislative efforts on health care and economic stimulus brought about significant backlash from Republicans in Washington and at the grassroots level.

The bigger question, however, is whether a president can recover after early stumbles. This is even more relevant in this ultra-polarized era where a president starts with unified support from his base, but a shallow reservoir of "benefit of the doubt" from the opposite party or independent voters. In other words, a president doesn't get much of a bump in approval rating when things go well, and he doesn't get much sympathy when he messes up (or is perceived to have messed up).

Trump was able to recover quite a bit from his 'summer swoon' of 2017. For example, at this point in 2017, Trump's job approval rating had plummeted to just 37 percent. But, by late October of 2018, his approval had climbed 6 points to 43 percent. That wasn't enough to help Republicans hold onto their House majority, but his stronger standing was enough to help red-state candidates expand their majority in the Senate.

However, the challenge for Biden is that these early mistakes go directly to the very rationale of his presidency; that it would be low drama and high competence. This was especially true with Afghanistan. While Americans are eager to have our troops out of the country, and may even have assumed there'd be some chaos due to that drawdown, they also expected that this administration's deep expertise and experience, would prepare them for any unexpected snafu. That turned out not to be the case...

Haitian Migrant Crisis (VIDEO)

DEL RIO, Texas (AP) — Many Haitian migrants camped in a small Texas border town are being released in the United States, two U.S. officials said Tuesday, undercutting the Biden administration’s public statements that the thousands in the camp faced immediate expulsion.

Haitians have been freed on a “very, very large scale” in recent days, according to one U.S. official who put the figure in the thousands. The official, with direct knowledge of operations who was not authorized to discuss the matter and thus spoke on condition of anonymity

Many have been released with notices to appear at an immigration office within 60 days, an outcome that requires less processing time from Border Patrol agents than ordering an appearance in immigration court and points to the speed at which authorities are moving, the official said.

The Homeland Security Department has been busing Haitians from Del Rio to El Paso, Laredo and Rio Grande Valley along the Texas border, and this week added flights to Tucson, Arizona, the official said. They are processed by the Border Patrol at those locations.

A second U.S. official, also with direct knowledge and speaking on the condition of anonymity, said large numbers of Haitians were being processed under immigration laws and not being placed on expulsion flights to Haiti that started Sunday. The official couldn’t be more specific about how many.

U.S. authorities scrambled in recent days for buses to Tucson but resorted to flights when they couldn’t find enough transportation contractors, both officials said. Coast Guard planes took Haitians from Del Rio to El Paso...

What Comes Next for Portland? (VIDEO)

At the New York Times, "After a Year of Protests, Portland Is Ready to Move On. But Where?":

PORTLAND, Ore. — Defund the police? City leaders in Portland tried it. A unit in the fire and rescue bureau, one of the first of its kind in a major city, began this year taking some 911 calls about people in crisis, especially those who are homeless.

Instead of police officers with flashing lights and guns, a paramedic and a social worker would drive up offering water, a high-protein snack and, always and especially, conversation, aiming to defuse a situation that could otherwise lead to confrontation and violence. No power to arrest. No coercion.

“Having someone show up and offer you goods rather than run you off is different, and people respond to it — it softens the mood,” said Tremaine Clayton, a burly, tattooed veteran of 20 years at the fire and rescue bureau who helps run the program.

But this spring, just as the project was preparing for a major rollout into more neighborhoods, there was another plot twist: The new policing alternative was itself mostly defunded. The city decided on a go-slow approach, and the promised $4.8 million expansion evaporated.

Portland, the Oregon city of bridges, bike lanes and left-leaning idealists — beloved, abhorred and caricatured in just about equal measure — is wrestling mightily with the question of what it means to make a city safe and, as it gradually opens up from the Covid-19 shutdowns, to feel safe, too. It is an issue that many American cities are addressing as the economic and societal disruptions of the past year linger and resonate.

Violent crime, especially homicide, has spiked in most urban areas during the pandemic, and many police departments are facing new scrutiny about training and bias since the murder of George Floyd in Minneapolis a year ago.

But here in the nation’s 25th-largest metropolitan area, with about 2.5 million people, there is an additional factor that ripples through every public policy choice, and that even the city’s top prosecutor said has to a degree warped the debate about what to do to rebuild a city that Portlanders want and love.

A hardened core of street activists, many of them professing opposition to authority in general, has dug in and shows no signs of going away. (Portland’s mayor, Ted Wheeler, has asked people to stop calling them protesters, but rather what they call themselves: anarchists.) Their numbers are now down to perhaps 25 to 75 on any given night, compared with hundreds in late 2020 and the many thousands who marched last summer in protests after Mr. Floyd’s murder.

But they have shown themselves at times to be violent — one was charged with attempted murder after a Molotov cocktail was thrown at the police — destructive of property and highly adaptable, using social media tools and other strategies to divert the police from the targets they select.

Direct actions are promoted on social media with the phrase “No gods, no masters,” a 19th-century anarchist term that indicates a rejection of all forms of authority. More traditional protesters from Black Lives Matter and other movements who try to curtail violence are now ridiculed as “peace police” by the anarchists, who mostly consist of young, white men.

Demetria Hester, a member of Moms United for Black Lives, continues to push for defunding the police but disagrees with the current call for dismantling the entire political system. “Breaking windows is performative,” she said. “That satisfies them at night, but they don’t have a plan.”

Some prominent Black leaders have been formally distancing themselves, with some calling the anarchists’ rejection of gradual progress just another symbol of privilege that Black people do not have.

“Being able to protest every night is a white privilege, being able to yell at a police’s face is a white privilege,” said Gregory McKelvey, a prominent Black organizer who ran the mayoral campaign last year for Mr. Wheeler’s opponent, Sarah Iannarone. “Most Black people across the country do everything they can to avoid cops.”

Still, Mr. McKelvey has empathy for those who feel that taking to the streets is their only outlet. “These are people who have felt like they’ve had no agency or power in their life or in the political system,” he said. “They want to feel powerful, and when you can have the mayor talking about you every single day, and hundreds of police officers show up to fight you every day, you feel more powerful than when you’re sitting at home.”

The protests have led to vicious finger-pointing over who was to blame for the serial destruction that has left so many downtown storefronts shattered and covered with plywood.

 

Andy Ngo Needs a Bodyguard (VIDEO)

I responded to Mr. Ngo on Twitter earlier: "Maybe time to hang it up for a bit? Write another book? I don’t know? Get out of Portland for a while?"

The man cannot continue to do his coverage of Antifa all alone. He needs at least a bodyguard, if not a full force-protection squad surrounding him when he's out doing his thing. He will be killed. He says himself he's had a couple of dozen of death threats, and it was just a year or two ago the he was beaten to an inch of his life. He's moved back to Portland to care for his parents, but hey, his parents won't have a son too much longer if he keeps it up. Like I suggested, maybe it's time for him to pass the baton? Write books? Let someone else take up the mantle of on-the-ground reporting like this? 

I don't know? Life's too short.

Now, as you know by now, I do check out CBS This Morning when I can, and as noted previously, it's the only national morning show I can watch, because the others previously mentioned are so far to the loony left that, well, it's just impossible for me to even contemplate taking these goons seriously. 

And very interestingly here, CBS's investigative reporter is none other than former Fox News correspondent Catherine Herridge, who is freakin' good, and I'll bet she got a hefty pay raise to take the job at CBS; and, from what I've heard, Fox News already pays its reporters handsomely, so good for her for making bank AND still being able to report honestly on this blockbuster cluster of a situation (and CBS should be lauded for that). 

My long headline above pretty much includes all the relevant points I might expand on in the post here, but I just have to note that if anyone looks bad --- and all the relevant official parties in D.C. and in the federal government look bad, except for former President Trump, who indeed requested a full deployment to the Capitol building, as a "preemptive" measure to guarantee security there, so I can't see how anyone in the leftist media can still blame him (but they will) --- it's Mayor Bowser; but of course all of the "M.S.M." ghouls will certainly find a way to praise her, so just f*ck 'em, as they're the biggest asshole lying media hacks anywhere, even worse than those in the official state media of Communist China or the evil propagandists for Vladmir Putin's extremely repressive regime in Moscow, now basically murdering dissident Alex Navalny by imprisoning him and denying him healthcare, after he came down with some mysterious new and suspicious COVID-like symptoms; but don't worry, the Biden administration will indeed find a way to beat out these two murderously un-democratic monster regimes, and that really is really something, when you think about it.

A series of photos run in the June 1940 issue of Life magazine warned of "signs of Nazi Fifth Column Everywhere". In a speech to the House of Commons that same month, Winston Churchill reassured MPs that "Parliament has given us the powers to put down Fifth Column activities with a strong hand." In July 1940, Time magazine referred to talk of a fifth column as a "national phenomenon". 

With the left’s crackdown on civil liberties and free speech, the Democrat Party and its Antifa/BLM minions are the real threat to the Republic. Gird your loins, patriots!

Riots and Demonstrations from Portland to Jerusalem

Over the past several years, public discourse in the United States has seen a lot of new lows. It saw another one this month when House Speaker Nancy Pelosi referred to federal officers in Portland, Oregon as “stormtroopers,” that is, Nazi Brownshirts.

In a tweet on July 18 and in subsequent remarks, Pelosi accused the federal forces deployed to Portland of “kidnapping protesters and causing severe injuries in response to graffiti.”

Pelosi’s allegations would cause a political earthquake – if they were true. But they aren’t true. And the fact that she slandered federal officers as Nazis is a deeply disturbing testament to where the Democratic Party – of which she is the senior elected official – stands today and what its intentions are.

For the past two months, the progressive city of Portland in the progressive State of Oregon, has been the scene of chaos and rioting. The liberal media have misleadingly characterized the riots as “peaceful demonstrations.”

Night after night, hundreds of “peaceful demonstrators” have vandalized and destroyed stores and other businesses, transforming downtown Portland into a war zone. Over the past five weeks, the focal point of the violence has been the federal courthouse.

“Peaceful protesters” from Antifa and other radical groups have been attacking the federal courthouse in Portland with incendiary devices including pipe bombs and commercial grade fireworks. Federal officers charged with guarding the courthouse have been blinded with lasers and attacked with stones, metal balls shot from slingshots, bricks and two-by-fours, among other things.

The rioters are backed in their efforts by city and state officials as well as national Democrats who have castigated federal forces protecting the courthouse as “occupiers,” the “Gestapo” and of course “stormtroopers.”

As for the alleged “kidnapping” of peaceful protesters, local journalist Andy Ngo explained this week that Pelosi’s statement channeled Antifa propaganda.

Ngo told Fox News, “That’s an Antifa talking point that is being repeated by sympathetic media.”

He explained that federal officers charged with protecting federal property are using plainclothes agents in unmarked vehicles to peacefully apprehend leaders of the violence. This is a routine, entirely legal tactic which Ngo explained is only being castigated now is because “it is quite effective.”

On the face of it, as Democratic politicians, Pelosi and her colleagues in Congress and Oregon should support the federal forces trying to end the riots. After all, like New York, Chicago, Minneapolis and Los Angeles, Portland is a Democratic city. The businesses being destroyed are owned by their voters.

So why are Pelosi and her partisan colleagues and their media adjuncts instead depicting the rioters rendering downtown Portland a war zone as “peaceful protesters” and slandering the law enforcement officers defending federal property as Nazis?

The obvious answer is politics. The Democrats support the rioters because as they see things, the longer chaos reigns in the streets of America’s cities, the better their chances of defeating President Donald Trump in November.

The Democrats have a number of resources that the Republicans lack and the riots bring them all to bear. They have fanatical progressive activists angry that Bernie Sanders isn’t the nominee but willing to burn America.

They have wall to wall support from the media from NBC to the New York Times to Facebook and Twitter.

The Democrats have limitless funds to maintain the violence and mayhem indefinitely. This week, Alexander Soros, George Soros’ son announced that the family foundation has earmarked another quarter billion dollars to Black Lives Matter. And the Soroses are not alone.

As the past four years of Trump-Russia mythology and legally baseless, politicized prosecutions and investigations have shown, the Democrats control much of the so-called Deep State which controls the levers of the permanent bureaucracy.

The Trump-Russia collusion narrative largely disintegrated under the weight of evidence and the absurd impeachment process over the past several months. And with its decline the Democrats began casting about for a new cause.

They found it with the coronavirus pandemic. In one fell swoop, the virus from China swept away Trump’s fast-growing economy with record low unemployment across all ethnic and racial groups.

With schools abruptly closed and jobs abruptly lost the optimistic America of 2019 became the destabilized, poor, frustrated and insecure America of 2020.

Yet, despite the best efforts of the commentators, support for Trump was not falling apart, at least not enough to ensure an electoral victory for Joe Biden. And Americans were beginning to figure out a way through, as the rising stock market indexes indicated.

But then came the riots. The proximate cause of the riots and protests was the police killing of George Floyd. But their context was the pandemic and the elections in November. The riots gave the Democrats a way to galvanize their radical progressive base (on the streets, in Congress and in the media) around their favorite issues – race and identity politics.

For the Democrats, the best part of the riots is that unlike the pandemic, for demonstrators and their media flacks, it is easy to make the case that Trump is to blame.

Trump’s in charge and America is burning. Trump’s to blame. Trump’s in charge and there is racism in America. Trump’s to blame.

If Trump quells the riots, he will be guilty of police brutality, (with stormtroopers) – thus proving the point. If he fails to quell the riots, he is an ineffective boob. And so, with a bottomless pit of money, the riots will continue, at least so long as the Democrats feel they benefit from them, and they haven’t figured out something else to do...

"Protestors in California," tweeted ABC News, about an incident in Oakland, "set fire to a courthouse, damaged a police station and assaulted officers after a peaceful demonstration intensified."

If you'd presented your ninth-grade teacher with that sentence in your weekly writing assignment, she might have taken out her red pen and asked you, "How does a peaceful demonstration intensify?"

This sentence, however, was written not by a ninth-grader but by an adult, a professional journalist working for one of the world's major television news organizations. It was not an accident. As Modern Age editor Daniel McCarthy noted, "George Orwell could not improve on this."

Any "peaceful demonstration" capable of "intensifying" into setting fire to a courthouse, damaging a police station and assaulting law enforcement personnel was never really "peaceful" in the first place.

As The New Criterion editor Roger Kimball wrote, "the overriding criterion for choosing which narrative to plug" is which "will do the most damage to Donald Trump and Republican prospects in the November election."

The narrative that serves that purpose is that the demonstrations that broke out after the May 25 death of George Floyd are peaceful, and the demands of many demonstrators to "defund" the police are a reasonable response with no downside risk. Video footage suggesting the contrary has appeared sparingly, if at all, on broadcast news, CNN and MSNBC...

The right to bear arms? Ha.

Freedom of speech? Association? Peaceable assembly? Ha. Ha. Ha.

It’s not “socialism” or “communism” under which we suffer. Our dangerously chaotic, selectively oppressive predicament is more accurately described as “anarcho-tyranny.” The late conservative columnist Sam Francis first coined the term in 1992 to diagnose a condition of “both anarchy (the failure of the state to enforce the laws) and, at the same time, tyranny—the enforcement of laws by the state for oppressive purposes.”

The “criminalization of the law-abiding and innocent,” Francis expounded, is achieved in such a state through:

• “exorbitant taxation, bureaucratic regulation;
• the invasion of privacy, and the engineering of social institutions, such as the family and local schools;
• the imposition of thought control through ‘sensitivity training’ and multiculturalist curricula;
• ‘hate crime’ laws;
• gun-control laws that punish or disarm otherwise law-abiding citizens but have no impact on violent criminals who get guns illegally;
• and a vast labyrinth of other measures.”

The toxic combination of Pandemic Panic and George Floyd Derangement Syndrome has thoroughly destroyed the home of the brave. It is a paradise for the depraved and dictatorial.

Anarcho-tyranny is how hoodlums can toss statues into rivers with impunity, while citizens disgusted by Black Lives Matter street grafitti are charged with “hate crimes” – as David Nelson and Nicole Anderson in Martinez, Calif., were by a George Soros-funded district attorney two weeks ago.

Anarcho-tyranny is how rioters can shut down highways and byways on a whim without fear of arrest, while commuters trying to escape the window-smashing barbarians obstructing traffic are charged with “assault”—as poor Jennifer Watson of Denver, Colo., was this week.

Anarcho-tyranny is how hordes of gay pride activists marching shoulder to shoulder can defy social distancing guidelines with gushing approbation from radical left-wing medical “experts,” while anti-lockdown and anti-mask mandate protesters are deemed public health menaces who now face snitch hotlines, fines, house arrest, or jail time.

Anarcho-tyranny is how 1,000 black militia members can take over the streets in Georgia and point their guns at motorists as they demand reparations, while white citizen militia members in Idaho, Utah, and New Mexico have been smeared publicly as racists and face injunctions for peacefully defending their neighborhoods.

Where do the police stand in this regime? It pains me to say it, but those of us who have backed the blue so loyally and vocally can no longer do so under the assumption that the blue will back us.

It’s rank and file cops who are issuing citations to citizens who want to breathe freely.

It was rank and file cops in Denver who watched as my patriotic friends and I tried to hold a Law Enforcement Appreciation Day this past Sunday were besieged by Black Lives Matter and Antifa thugs who had declared that their sole intent in invading our permitted celebration was to “shut us down.” I livestreamed the chaos as pro-police attendees were beaten, including the organizer Ron MacLachlan, who was bloodied in the face and head just a few feet from me by black-masked animals. One Antifa actor wielded her collapsible baton just inches from me.
